Consumer Products
The Firm has been at the forefront of consumer products litigations. Our attorneys have in-depth knowledge and experience in these actions and retain the top industry and product line experts to assist them to victory.
Recently, our Firm committed to stop the large polycarbonate plastic baby bottle manufacturers from selling their baby bottles and training cups that contain a chemical called Bisphenol-A. Over the last decade, scientists have been able to confirm through laboratory studies that Bisphenol-A is implicated in increased prostate and breast cancers, sexual organ deformity, premature onset of puberty in females, and childhood obesity, diabetes, autism and attention deficit disorders
Our Firm filed the first Bisphenol-A Consumer Class Action case in the country in March 2007 alleging that the polycarbonate plastic baby bottle companies knew about the dangerous toxicity of their plastic products but chose not to disclose or warn parents that their children would be subjected to an increased risk of permanent and irreparable harm and injury. We took on the baby bottle manufacturers such as Playtex, Gerber, Evenflo and others. A central court has been created to administer the cases in Multi-District Litigation and we were appointed by the court to the Plaintiffs’ Steering Committee, along with a small group of other nationally known plaintiff’s law firms designated to manage and supervise the national litigation
On February 24, 2009, the Firm’s founder, Robert H. Weiss, testified at the FDA’s Science Advisory Committee on Bisphenol-A (“Committee”) hearing. Mr. Weiss stressed the severe consequences of Bisphenol-A exposure by infants and children, and demanded on behalf of parents and families across the country that the FDA take immediate action to regulate Bisphenol-A and require the removal and recall of infant and child products containing Bisphenol-A. The Firm’s Managing Attorney, Stephen D. Murakami, provided similar testimony to the Committee on October 31, 2008. Our Firm will continue to lobby the FDA until our demands are met and our country’s children are safe from this dangerous toxin.
Pharmaceutical and Medical Device Practice
The attorneys in our pharmaceutical and medical device practice group have distinguished records of successfully litigating drug-related actions. Our Firm has been involved in several national, well publicized pharmaceutical cases including, Vioxx, Bextra, Zyprexa, Accutane, and Bausch and Lomb Renu.
We have also been involved in medical device actions such as Medtronic’s defective defibrillator leads and heart stents. The Firm has developed a network of the leading industry experts in the world. Toxic Torts
The Firm’s toxic torts litigation group is devoted to zealously fighting for the rights of victims of hazardous substance exposure. Some of these cases are particularly abhorrent and involved unconscionable acts by companies placing greater value on their earnings than human life. For example, our Firm recently participated in a consortium of leading law firms representing dozens of families living in Somerville, Texas against Burlington Northern Santa Fe Corporation, the owner of a railroad tire factory in Somerville. This factory allegedly released creosote and other carcinogens into the community causing various forms of cancer in the residents and resulting in many unfortunate birth defects. The level of cancer and birth defects in the community is 60% higher than any other place in America. Based on investigations conducted by the consortium, management knew the grave and sometimes fatal consequences to the public in and around the factory. Less than a mile away from the factory is a high school. Grossly elevated levels of contamination were detected inside the building and have been absorbed by children.
The attorneys in this group possess a strong technical and scientific understanding of the subject matter of these actions, as well as knowledge regarding the injuries resulting from exposure to toxic substances, including mesothelioma cancer, asbestosis, non-small cell carcinoma and squamous cell lung cancer.
